1 Counter-Notice and Appeals

Winderk provides users with the right to dispute copyright removal if they believe content was taken down in error. The process includes:

  1. Submission of Counter-Notice

    • User provides:

      • Full legal name and contact information

      • A statement under penalty of perjury that the content was removed mistakenly

      • URL of the removed content

      • Signature (physical or electronic)

  2. Review by Winderk

    • The Copyright Team evaluates the counter-notice within 5–7 business days.

    • Verification includes reviewing the original takedown notice and context of the disputed content.

  3. Reinstatement of Content

    • If the counter-notice is valid, content is restored promptly.

    • Both parties are notified of the outcome.


 

3.2 Penalties for Repeat Infringement

Winderk enforces strict measures for accounts that repeatedly violate copyright:

  • First Violation: Warning and educational guidance.

  • Second Violation: Temporary suspension of account privileges.

  • Third Violation: Permanent account termination.

Note: Continuous monitoring ensures fair enforcement and protects legitimate creators.


 

3.3 Transparency Reporting

To maintain community trust, Winderk may publish transparency reports:

  • Number of copyright claims received

  • Number of posts removed

  • Number of counter-notices filed

  • Trends in violations and resolutions

These reports help users understand enforcement trends without revealing private user data.

  • Use proper attribution for transformative or derivative works.

  • Avoid repeated uploads of content that has been flagged previously.

  • Educate yourself on copyright laws in your jurisdiction to prevent violations.
