1. Introduction and Overview
Winderk is a platform designed for users to create, share, and interact with content globally. This section outlines the rules and responsibilities surrounding content ownership, user rights, platform rights, intellectual property, and legal obligations.
All content posted, uploaded, or shared on Winderk is subject to these Terms. Users retain ownership of their original work, but by using the platform, you grant Winderk the license to use your content in specified ways.
The purpose of these policies is to:
Protect the rights of users and creators.
Protect Winderk from liability.
Ensure the integrity and safety of the platform.
Provide clear guidance on monetization, sharing, and reporting content violations.
2. User Ownership of Content
2.1 Retention of Rights
Users retain copyright, moral rights, and other legal rights over content they create, including:
Text (posts, blogs, comments)
Images and photography
Videos and audio clips
Graphics and illustrations
Links, polls, and interactive content
Example: If a user creates a photography series and posts it on Winderk, they continue to hold the copyright. Winderk does not claim ownership, but may use the content under license for operational purposes.
2.2 Responsibility for Ownership
Users must ensure they:
Own the content they post, OR
Have explicit permission/licensing from the owner.
Scenario: A user posts a music clip they do not own. If a copyright owner submits a takedown notice, the content will be removed, and repeated violations may lead to account suspension.
2.3 Prohibited Claims
Users may not claim ownership of content they do not own. Examples include:
Reposting someone else’s blog without permission
Sharing copyrighted videos or images without authorization
Using AI-generated content labeled as someone else’s work
3. Licensing Winderk Receives
3.1 Non-Exclusive License
By posting content, users grant Winderk a non-exclusive, worldwide, royalty-free, sublicensable license to:
Host, store, and display content on Winderk.
Share content across Winderk services and affiliated platforms.
Use content for analytics, AI, or ML purposes.
Promote the Platform or user-generated content in campaigns.
Note: This license is non-exclusive, meaning you retain all other rights and can post your content elsewhere.
3.2 Duration and Scope
The license remains active as long as the content is on the platform.
Removing content terminates Winderk’s future usage rights but does not affect past use for operational or legal purposes.
Example: If a user deletes a video after monetizing it, Winderk may keep archived copies for revenue reconciliation or analytics.
4. Intellectual Property Guidelines
4.1 Copyright Compliance
Users must follow copyright law and post only content they have rights to.
Winderk operates a DMCA-style takedown process: copyrighted content can be removed upon notice.
4.2 Trademark and Branding
Users cannot use logos, brand names, or trademarks without permission.
Misuse may lead to content removal or account suspension.
4.3 Patents and Proprietary Rights
Posting content that infringes patents, trade secrets, or other intellectual property is prohibited.
Users may be liable for damages resulting from infringements.
5. User-Generated Content (UGC)
5.1 Definition
UGC includes all content created and uploaded by users:
Posts, comments, and blogs
Images, videos, and audio
Links, polls, and interactive elements
5.2 Responsibilities
Users guarantee content is original or properly licensed.
Respect the intellectual property rights of third parties.
Misuse may result in content removal, account suspension, or legal action.
5.3 Monetization and Rights
Monetized content remains user-owned, but Winderk requires a license to display and distribute it for revenue purposes.
Fraudulent activity, such as manipulating views or engagement, violates Terms.
6. Platform Rights & Restrictions
6.1 Right to Remove Content
Winderk may remove content violating Terms or applicable laws.
Removal may occur without prior notice depending on severity.
6.2 Use for Analytics and AI
Anonymized or aggregated content may be used for analytics, research, or AI/ML purposes.
Users retain ownership while allowing operational usage.
6.3 Promotional Use
Publicly shared content may be used in marketing campaigns, banners, or educational materials.
7. Handling Third-Party Content
7.1 Sharing and Embedding
Only share or embed third-party content if authorized.
Unauthorized use may trigger takedowns.
7.2 Reporting Infringement
Winderk provides tools for reporting intellectual property violations.
Claims are reviewed promptly, and content may be removed if valid.
8. User Warranties and Indemnification
Users warrant ownership or permission for content.
Users indemnify Winderk for any claims arising from content violations.
Examples: posting copyrighted video without permission, claiming authorship falsely.
9. Copyright Infringement Policy
9.1 Takedown Procedure
Submit a notice via Winderk’s reporting tool.
Include proof of ownership and contact information.
9.2 Counter-Notice
Users who believe content was removed in error may submit a counter-notice.
Winderk will review and may restore content if valid.
9.3 Repeat Infringer Policy
Accounts repeatedly infringing copyrights may be suspended or terminated permanently.
10. Content Liability
Users are responsible for all content posted.
Winderk is not liable for:
Third-party misuse
Loss of revenue or reputation from content removal
Legal claims from user content
11. Monetized Content
Monetized content must comply with content ownership rules.
Revenue-sharing calculations require accurate reporting of ownership.
Manipulating engagement metrics is prohibited.
12. Content Removal & Appeals
Users may request removal or dispute takedowns.
Winderk reviews requests and resolves disputes based on policy.
13. Data Retention
Winderk may retain removed content for legal, operational, or compliance reasons.
Users consent to retention as part of platform use.

Examples:
Posting someone else’s video without permission → content removed, account warned

FAQs:
Can I post content I found online? Only if you have permission or it’s licensed for reuse.
What happens if my post is taken down? You can submit a counter-notice.
Can I monetize reposted content? No, only original or licensed content is eligible.
