1. Welcome to Winderk

Winderk is a global social media and content-sharing platform (“the Platform”), operated by Winderk Inc. (“Winderk,” “we,” or “our”). By accessing, browsing, or using Winderk in any manner — whether through web, mobile, or other devices — you agree to comply with these Terms of Service and all other policies referenced herein.

If you do not agree to these Terms, you must not create an account, post content, or use any features of the Platform. Your continued use of Winderk constitutes acceptance of all provisions outlined here, including future updates.

These Terms are a legally binding agreement between you (“user,” “you,” or “your”) and Winderk. They define your rights, responsibilities, and obligations when interacting with the Platform, other users, and Winderk staff.

2. Scope of the Agreement

By using Winderk, you acknowledge and agree that:

  1. These Terms govern your access to and use of all services, features, and content offered by Winderk.
  2. Your use is subject to all applicable laws and regulations, including those relating to online conduct and content.
  3. Winderk may provide additional guidelines, policies, or rules for specific features (e.g., monetization, advertising, or API access), which are incorporated by reference and are enforceable under this agreement.
  4. You are solely responsible for complying with these Terms and any local laws that apply to your use of the Platform.

3. Acceptance of Terms

By creating an account, posting content, interacting with other users, or simply using Winderk, you affirm that you:

  • Have read, understood, and accepted these Terms and all related policies.
  • Agree to comply with Winderk’s Community Standards, Privacy Policy, Monetization Policy, and any other relevant rules.
  • Acknowledge that Winderk may update these Terms at any time. Continued use after updates constitutes acceptance of the changes.

Winderk will make reasonable efforts to notify users of significant changes, but it is your responsibility to review these Terms periodically. Failure to review does not exempt you from compliance.

 

4. Platform Modifications

Winderk may, at its discretion and without prior notice:

  1. Add, modify, suspend, or discontinue any feature, service, or functionality.
  2. Remove or block content that violates these Terms, other policies, or applicable law.
  3. Update, restrict, or terminate user access to certain areas or features of the Platform.

These modifications may affect the way you interact with Winderk, including content posting, messaging, and monetization features. By continuing to use the Platform after modifications, you accept the revised conditions.

 

5. Definitions

For clarity, the following terms are defined as used in this agreement:

  • “Content” – Any text, images, videos, links, comments, or other material uploaded or shared by users.
  • “User” – Any individual who creates an account or uses Winderk services.
  • “Account” – A personal profile or other identifier that allows access to Platform features.
  • “Platform” – Winderk and all associated services, applications, websites, and APIs.
  • “Community Standards” – Rules governing acceptable behavior and content on Winderk.
  • “Monetization” – Any system through which users may earn rewards, revenue, or compensation from their activity on Winderk.

6. Legal Relationship

This agreement does not create any partnership, employment, or agency relationship between you and Winderk. You are an independent user with rights and obligations as described herein.

  • Users retain ownership of content they create but grant Winderk a non-exclusive, worldwide, royalty-free license to display and distribute content on the Platform.
  • Winderk reserves the right to remove content at any time if it violates Terms, policies, or applicable laws.
  • Users are solely responsible for their own content, conduct, and compliance with all relevant laws.

7. Age and Eligibility

You confirm that:

  1. You meet the minimum age requirement (13 years old, or local legal age in your jurisdiction).
  2. You have the legal capacity to enter into a binding agreement.
  3. You are not barred by any law or regulation from accessing social media platforms or online services.

Accounts that fail to meet eligibility criteria may be suspended or permanently terminated.

 

8. Consent to Electronic Communications

By using Winderk, you consent to receive communications from us electronically. This includes:

  • Account notifications
  • Policy updates
  • Promotional messages

You agree that electronic communications satisfy any legal requirement for written notice.

 

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria (or your local jurisdiction if different).

  • Any dispute arising from these Terms or your use of Winderk shall be subject to local law and resolved via arbitration or the courts of the governing jurisdiction.
